Acceptable Use and API Policy
This Policy supplements, and is incorporated by reference into, the HowToRomania Terms of Service (the "Terms"). Defined terms have the meaning given in the Terms unless defined here.
1. Purpose
1.1This Policy sets out the technical and legal rules for using the HowToRomania API and MCP server (the "Service"), including when access is automated through an AI agent, assistant or other autonomous system (an "Agent"). It applies to every API key, whether created by a human or provisioned programmatically.
2. Rate limits, quotas and fair use
2.1You must stay within the rate limits, credit quotas and endpoint-specific call limits published in our API documentation, as updated from time to time. We may throttle, queue or reject calls that exceed those limits. You must not use multiple keys, accounts, IP addresses, proxies or Agents to circumvent a rate limit, credit quota or the free-credit allowance described in the Terms.
3. Prohibited technical conduct
3.1You must not:
3.2probe, scan, or test the vulnerability of the Service or any system or network connected to it, except through a responsible disclosure process we publish;
3.3reverse engineer, decompile or disassemble any part of the Service, except to the extent such restriction is prohibited by applicable mandatory law;
3.4interfere with or disrupt the integrity or performance of the Service, including by introducing malware, sending abusive or disproportionate traffic, or attempting denial-of-service activity;
3.5use automated means to scrape, crawl or systematically extract data from the Service at a volume or pattern designed to reconstruct, mirror or replicate the underlying datasets, beyond ordinary call-by-call use of the Service for your own product or workflow;
3.6circumvent, disable or interfere with any security-related feature of the Service, including authentication, rate limiting or credit metering;
3.7misrepresent the identity of the caller, including by spoofing headers, falsifying an API key's origin, or disguising Agent traffic as human traffic where the Service's terms of use depend on that distinction.
4. Prohibited data uses
4.1You must not use the Service, or permit an Agent acting on your behalf to use the Service, to do any of the following. The prohibition on resale below is treated as the most serious breach of this Policy and carries the specific consequences described in it.
- 4.2resell, sublicense or redistribute Service data in any form. You must not resell, sublicense, redistribute, broker or otherwise commercially exploit, directly or through an Agent or any third party, any data, score, report or other output obtained through the Service, whether as a standalone product, a bundled feature, a bulk dump, a mirror, a feed, a database, or training/grounding data for another product or model. This is an express, standalone prohibition under Section 8B of the Terms. Breach has serious consequences: under Section 8B and Section 15 of the Terms, our liability to you for any claim connected with the resold or redistributed data drops to zero to the maximum extent the law allows, you must indemnify us in full for any resulting loss or third-party claim (including claims from a Source Site, a data subject or a regulator), and we may suspend or terminate your key immediately without refund.
4.3build or offer a product or service that competes with the Service by substantially replicating its datasets or functionality;
4.4re-identify, or attempt to re-identify, a natural person whose name has been masked in court data returned by the Service;
4.5construct an index, list or profile of all companies, proceedings or filings associated with a named natural person (for example an "all entities linked to person X" lookup), whether by chaining calls to the Service, by combining Service data with other sources, or otherwise;
4.6make, or materially inform, a decision producing legal or similarly significant effects on a natural person (including decisions about credit, employment, housing, insurance, or eligibility for a service) using Service data, without meaningful human review of that decision;
4.7present Service data, including risk scores or flags, as an official certificate, government record, credit rating, or statement issued or endorsed by a public authority;
4.8use Service data in a manner that would breach the data protection, consumer protection, competition, sanctions or other applicable law of any jurisdiction in which you operate.
5. Source Site terms remain independently binding
5.1As set out in Section 8A of the Terms, each underlying public source ("Source Site") may impose its own terms of use, licence conditions or technical restrictions on the data it publishes, independently of this Policy and of the Terms. Complying with this Policy and the Terms does not relieve you of your independent duty to check and comply with the applicable Source Site's own terms before you resell, redistribute, or otherwise make available to a third party any data originating from that Source Site – and, in any event, the resale and redistribution of Service data is independently and absolutely prohibited under Section 4 of this Policy and Section 8B of the Terms, regardless of what a Source Site's own terms might otherwise permit. If you are uncertain whether an intended use is permitted by a Source Site's terms, contact the Source Site or seek your own legal advice; we are not able to advise on another party's terms of use.
6. Agents and automated callers
6.1If you connect an Agent to the Service, you must configure it so that it does not, on its own initiative, breach Sections 2 to 5 of this Policy. You remain fully responsible for your Agent's conduct, as set out in the Terms. We may apply additional technical controls to automated or high-volume traffic patterns, including stricter rate limits or additional verification, without notice, where we reasonably believe this is necessary to protect the Service, a Source Site, or the rights of others.
7. Reporting and enforcement
7.1If you become aware of a breach of this Policy, including by an Agent acting on your behalf or on behalf of a third party, tell us at hello@howtoromania.io. We may investigate suspected breaches, request information, and take any of the actions described in Section 13 of the Terms (including suspension or termination of a key) where we reasonably believe this Policy has been breached.
8. Changes to this Policy
8.1We may update this Policy on the same basis as the Terms. Material changes will be notified as described in Section 16 of the Terms.
